E-Cigarette Dangers Prompting Lawsuits

One such accident occurred in Florida. Evan Spahlinger, 21, alleges that his e-cigarette exploded in his face, causing undue damage to his face. According to the suit, Vaping American Made Products, the maker of Spahlinger’s e-cigarette, should have told its customers about the known risk of using these devices. The suit also claims that the seller of the e-cig, Vaping Station, failed to warn its own customers of the dangers of these products.

In this particular situation, Spahlinger, the victim, was struck in both his chest and face by shrapnel from his e-cigarette after it exploded. Not only was he injured externally, but he inhaled smoke, fire and hot air, causing damage to his insides. The victim was taken to a hospital and promptly transferred to its burn unit. He nearly suffocated from his internal burns, and was on a ventilator for days.

Suits such as these are calling to light the danger behind these largely unregulated products. Many brands of e-cigarettes are not put through any type of safety tests before they are released to the public. Consumers are being injured thanks to an unregulated industry. According to his attorneys, Spahlinger will require months of follow up medical care. This extensive care will cause him to lose work and, in turn, money that is necessary to live on.

The defendants in this case have yet to file a response. It is expected that more people will come forward with their injuries after seeing how this case proceeds and, ultimately, how it ends. A similar case in 2013 was won by a California woman who had been injured by an e-cig. That woman received $1.9 million in her successful suit.
