IVC Filters Are a Dangerous “Solution.”

If you or a loved one has suffered from blood clots in your legs, there’s a chance your doctor implanted an inferior vena cava (IVC) filter. These filters are designed to catch and break up clots before they make it to your lungs, heart or brain. While this sounds great in theory, in practice, IVC filters can be incredibly dangerous.

These filters have been known to cause injury and even death. According to a recent study, at least one type of IVC filters has been linked to 27 deaths and more than 300 non-fatal injuries. For those who have filters implanted, these are terrifying statistics, especially considering they are a few years old. Yet, getting compensation for any injuries caused by IVC filters can be incredibly difficult, even though their dangers are well-known.

What Are the Common Injuries Caused by IVC Filters?

Perhaps the most dangerous part of having an IVC filter implanted is the risk of it breaking. If part of it breaks off, it can easily travel through the bloodstream, affecting the lungs, heart or other vital organs. There are also reports of IVC filters completely migrating, which can, at best, makes it lose its efficacy. At worst, it can tear blood vessels, causing internal bleeding.

In some cases, the filter can “tilt.” When it does, it can become embedded in the vein. If this happens, retrieving the filter can be practically impossible. And because these are not meant to be a permanent solution, an embedded filter can cause many problems.

Concern Over IVC Filters Is Common.

If you or a loved one has an IVC filter implanted, it’s common to have many different questions. These may include:

  • Who will pay for my medical bills?
  • Am I entitled to compensation for lost wages?
  • How will I pay for my future medical care?
  • Who will pay for my loved one’s funeral expenses?
  • Can I be compensated for my loss of enjoyment of life?
  • What damages does the law allow me to claim?

You may also be wondering who you would name in a potential lawsuit. This depends on your unique situation. For instance, if your doctor knew there was an issue with an IVC filter, but implanted it anyway, they could be held liable. But if the manufacturer withheld information regarding the dangers of the filter, they could be named in a lawsuit. Every case is unique, which is why it’s vital to speak with a qualified attorney.
