South Carolina Roundup Lawsuit Lawyer

The Monsanto Roundup lawsuit is a glaring example of how a manufacturer’s indifference, fueled by corporate greed, can be devastating for unsuspecting consumers. A glyphosate formula invented in-house by John E. Franz in 1970 would turn Roundup into a household name. Shockingly, nearly 50 years later the giant chemical corporation would become infamous when its product became synonymously linked to non-Hodgkin’s lymphoma.

Pretense Sets the Stage for Roundup Lawsuits

In 1991, New York State began to voice its objections to Monsanto’s misleading advertisements. Among these were blatantly false claims that Roundup was:

“Safe as table salt”

“Practically non-toxic to mammals, birds, and fish”

“Biodegradable” and “Environmentally friendly”

On November 25, 1996 — after 5 years of repeated attempts had failed to persuade Monsanto to remove the messaging — New York Attorney General Dennis Vacco filed a lawsuit against Monsanto for false pretexts that glyphosate was harmless to humans. The case was settled for $50,000 and all New York objectionable references were eliminated.

Complicity Revealed in Roundup Cancer Lawsuit

Fast forward to 2018 and the first major personal injury lawsuit brought against Monsanto. Plaintiff Dewayne Johnson, a school groundskeeper was diagnosed 4 years earlier with non-Hodgkin’s lymphoma. Johnson’s claim attributed his condition to Monsanto’s failure to divulge the hazards of glyphosate (the main ingredient in Roundup’s formula).

When the verdict was delivered, Judge Bolanos also read aloud the following questions which had been posed to the jury and thus considered. They would set Johnson’s award at a startling $289 million, though it was later slashed by the judge to $78 million.

  • Did Monsanto know or should reasonably have known that users would not realize the danger?
  • Did Monsanto fail to adequately warn of the danger?
  • Was Monsanto’s failure to warn a substantial factor in causing harm to Johnson?

Dewayne Johnson’s jury answered “Yes” to each of these questions.

Two additional significant trials followed in 2019, with final judge awards of $80 million and 87 million, respectively. In Edward Hardeman’s case, San Francisco U.S. District Court Judge Vince Chhabria would allow evidence of ghostwriting by Monsanto in multiple scientific studies; their attempt to dispel negative analytical data. In the 3rd case, the jury agreed that Roundup was linked to the brain, spinal and bone cancers of Alva and Alberta Pilliod’s (stemming from non-Hodgkin’s lymphoma). These three cases would forever turn the tide on Monsanto’s denials of collusions and misrepresentations of Roundup.

Is Your Roundup Lawsuit Payout Imminent?

Having purchased Monsanto in 2018, Bayer is now the company liable for current and future claims of Roundup victims with non-Hodgkin’s lymphoma. To date, Bayer has appeared to be working toward a “financially reasonable” settlement. One immediate reaction from the business world was an 11% hike in company shares.

Seeing this debacle come full circle, to impending satisfactory settlements for the pain and suffering endured, is good fortune long overdue. Auger & Auger promises to fight for everything you are worth and keep you informed along the way. Multi-district litigation groups (MDLs) allow sharing of evidence but also make awards based upon each plaintiff’s degree of  suffering.
